This Data Processing Agreement ("DPA") forms part of the agreement between you ("Customer," "Controller") and FamIT Solutions and Technologies LLC ("Processor," "we," "us") for use of the Lead Loupe Service. It applies when we process personal data on your behalf in connection with lead management, outreach, and related features. Effective date: July 30, 2026.
Customer determines the purposes and means of processing Customer Data (leads, contacts, campaign content, and similar materials Customer submits). FamIT Solutions and Technologies LLC processes that data to provide the Service as described in the Terms of Service and Privacy Policy.
We process Customer Data only on documented instructions from Customer, including through use of the Service, unless required by applicable law. We will not sell Customer Data or use it to build unrelated marketing databases for third parties.
We require personnel who access Customer Data to maintain confidentiality and implement appropriate technical and organizational measures designed to protect personal data against unauthorized access, loss, or alteration, consistent with our Privacy Policy.
Customer authorizes us to engage subprocessors reasonably required to operate the Service (for example hosting, email delivery, payment, and analytics providers). We remain responsible for subprocessors' performance of obligations under this DPA.
Taking into account the nature of processing, we will provide reasonable assistance to Customer in responding to data subject requests and meeting obligations under applicable data protection law, to the extent such information is available in the Service.
We will notify Customer without undue delay after becoming aware of a personal data breach affecting Customer Data, and provide information reasonably available to us to help Customer meet notification obligations.
Upon termination of the Service, Customer may export available Customer Data through product features where supported. We will delete or return Customer Data in accordance with our retention practices and applicable law, except where retention is required by law.
Where personal data is transferred internationally, we will use appropriate safeguards as required by applicable law and as described in our Privacy Policy.
